What If My Security Cameras Also Get Part Of Neighbors Yard

What Can we do About a Neighbor's CCTV Camera?

Cctv Privacy Law Harassment Human Rights

Q.

I was wondering what activeness I can take with regards to a neighbour who has simply recently moved a CCTV photographic camera into his bedroom and is pointing it directly at our forepart door and ii bathroom windows.

Nosotros live in a courtyard development (five houses) and the camera is about 10-xv metres away and clearly visible. He already has an external camera pointing towards his own door which is absolutely of no issue, but I feel the second camera is in violation of our rights to privacy.

We have recently had some flooding bug, although his holding was not afflicted. The emergency services were called and he was seen standing watching everyone and fifty-fifty the fire brigade felt the need to comment.

Later that twenty-four hour period when council representatives were on site, in front of witnesses he "flew" at my wife and invaded her space and verbally attacked her. What can I exercise?

(D.Chiliad, sixteen October 2008)

A.

The primary laws surrounding the use Of CCTV are contained within the Data Protection Act 1998 only these practice not encompass domestic residences. Information technology is perfectly legal for a resident to install CCTV (even with recording and playback capabilities) and, in the normal course of events, this will be done to protect one's own belongings against the threat of intruders and trespassers.

When installed correctly and used for the correct purpose, residents who have installed CCTV will tend to have a positive effect on the reduction of criminal offense and anti-social behaviour occurring in the neighbourhood, as would be perpetrators of such actions would be less inclined to commit offences for fear of being caught on camera.

The problem, as you rightly pointed out, lies in the fact that you perceive that one of your neighbours' CCTV cameras is pointing directly at your property and this is a Privacy Issue. Every bit far as the police goes in this regard, it would be covered by the Homo Rights Deed under your rights to privacy. Article viii of the Act entitled "The Correct to Respect for Private and Family Life, Home and Correspondence" means that your neighbour might well be breaking the law hither.

Ideally, it would be improve if you could speak to the neighbours politely, explain the state of affairs to them and request that they make certain modifications to the CCTV organization so that information technology does not borrow on your privacy. However, given you stated that the man verbally attacked your married woman, the likelihood would seem to suggest that he would not be prepared to heed. Incidentally, the fact that the man verbally attacked your married woman might be also covered under the Human being Rights Act in terms of harassment alone. It's also likely that his behaviour will take been mentally noted, at to the lowest degree, past the council representatives then that could obviously go in your favour.

Therefore, I retrieve y'all have every right to contact your local authority or local police strength and have them come out to investigate. They would obviously need to exist satisfied that the installation was basically Causing Harassment, mayhap even bordering on voyeurism, and they could so accept action. Alternatively, get some communication starting time from a solicitor who has specialist knowledge in this area.

Y'all might too like...

Hi I take the true definition of the neighbour from across hell. From her constantly banging on the wall at all hours to trigger my dog barking so she can make anonymous complaints to the council. To telling people of colour that I'1000 a racist. And I've had said person verbally abuse me with vile racist remarks. Now this horrendous neighbour has installed two cameras that betoken straight into my front and back garden clearly breaching Article 8 of HRA 1998. The police refuse to assistance me equally does the housing quango. The latter because next door is a homeowner. I rang the police and initially was told "they are too busy to attend" so when I rang nearly the HATE Crime, I was told that …"They're were not enough police force to nourish" when I rang back a few days afterwards as theman who racially abused me did it again, I was told…"they didn't have whatever vehicles to attend". I was so fed up I asked, " who was running Blackpool Police force Station "NODDY" and would they similar me to place an add in the local newspaper asking for donations of run around cars so they tin can practice their jobs? To which I was told I was being rude. No I wasn't being rude!! No ane will help me! This awful neighbour tried to get neighbours to crush me upwardly concluding year. The private that abused me last year apologised and nosotros are at present friends, so at present the neighbour from hell has gone to neighbours downward the road to verbally attack me. I'm trapped in my home, I cannot sit in my garden every bit her and her son lookout me. I'm disabled, the merely reason she has installed them is to perve, considering I've never done annihilation to her!Assistance!!!!!

I idea domestic cctv was covered by law General Data Protection Regulation (GDPR) and the Data Protection Act 2018 (DPA18) therefore a neighbour can asking a copytheir data (audio and visual of them and belongings) over a given timeframe so request information technology's deleted and for information technology non to exist captured in the future ? https://ico.org.uk/your-data-matters/domestic-cctv-systems-guidance-for-people-using-cctv/

Hullo my neighbor has a hot tub which she placed 6 anxiety in front of her house and side by side to our fence. It'south direct nether my daughters bedroom window. She's put a marquee over it but has started having s*10 in it tardily at night with her boyfriend. You tin hear information technology very clearly and quite loudly. The Law say when it happens again they'll come out but it's likely they'll just deny it. I'm in Scotland btw. Our local authority is supposed to deal with these bug under anti social behaviour but East Lothian council aren't good at that. Any tips from anyone on here? When confronted, as you would expect, she'south abusive and vile. I don't have an effect with her doing what she wants in her hot tub but we don't want to hear it. I call up they might get off on knowing folks can hear so there's no adventure of them moving the hot tub farther downwards the 80 ft garden.

The man in number 4 Holmere cottages has put up a CCTV that records anyone who is walking on the green and last week moved it college so I am not able to do anything on my property without existence recorded. He is unreachable and unreasonable then no way to express my displeasure. He already stolen some of my land and has made hell for going on two years.I am not sure this is a police force matter but know the DPA he is breaking and at that place is no sign stating he is or has CCTV.

Perverts mr Mrs bowers. They moved

Ahole - 17-April-21 @ 3:16 AM

Thank you for article. The act has been updated Information Protection Deed 2018. I tin can accept an outdoor camera but it shouldn't exist pointing to the neighbours garden.I would take to suit information technology accordingly so that information technology was merely filming my property boundaries. Unless of course you've got permission from your neighbours, peradventure at that place is q mutual thief who is harrassing more than than one neighbour.

A - eleven-April-21 @ 9:33 AM
